Birdie Chance Terms of Service

Welcome to Birdie Chance. These Terms of Service ("Terms") outline your rights and responsibilities when using our platform. By accessing or using Birdie Chance, you agree to be bound by these Terms.
1. About Birdie Chance
Birdie Chance is an online peer-to-peer marketplace where users can list, buy, and sell used golf gear and accessories.
Birdie Chance is not a party to any transaction between users and does not own or sell the items listed. All transactions are between buyers and sellers.
2. Eligibility
To use Birdie Chance, you must:
- Be at least 16 years old, or have the consent of a parent or legal guardian to use the platform
- Be capable of entering into legally binding agreements
- Use your true and correct identity when creating an account
- Comply with all applicable laws and regulations
We reserve the right to verify your identity and/or suspend or terminate your account if you fail to meet these requirements.
3. User Accounts
- You are responsible for maintaining the confidentiality of your account credentials
- You must notify us immediately if you suspect unauthorised use of your account
- You may not create multiple accounts without permission
4. Listings and Offers
- Sellers must provide accurate, complete, and truthful descriptions of items
- Sellers may choose to enable the "make an offer" tool, allowing buyers to submit price offers below the listing price
- Items listed must not be stolen, counterfeit, illegal, hazardous, or violate any applicable laws
- Firearms, ammunition, tobacco, and alcohol are strictly prohibited
We reserve the right to edit, remove, or refuse any listing that breaches these Terms or our community standards.
5. Transactions
- All payments must be made through the Birdie Chance platform
- Sellers will receive payment only after the buyer confirms delivery or after the delivery period ends without dispute
- Buyers are responsible for any shipping costs unless otherwise stated
- Local pickup is available if offered by the seller, but payment must still be processed via Birdie Chance
- Sellers are responsible for ensuring all shipping information entered (including weight, and dimensions) is accurate. If incorrect information is provided and a courier rejects the label or requires additional postage, the Seller is solely responsible for any extra costs incurred
Birdie Chance charges sellers a 6.5% service fee on each transaction (minimum $0.75). Buyers are not charged any fees by Birdie Chance. Standard Stripe payment processing fees also apply to sellers in addition to the Birdie Chance service fee.
6. Identity Verification
To improve trust and safety, Birdie Chance may use third-party services to verify the identity of buyers and/or sellers. By using our platform, you consent to this process.
7. Returns and Refunds
Birdie Chance does not offer returns or refunds for change of mind purchases. Buyers are responsible for reviewing listing details, photos, item descriptions, and condition information carefully before completing a purchase.
Returns or refunds may be available only where an item received is significantly not as described. An item may be considered significantly not as described where:
- A different item was sent to the one listed;
- The item contains undisclosed damage or faults not shown or described in the listing; or
- The item materially differs from the listing description or photos at the time of purchase.
Returns and refunds are not available for:
- Change of mind;
- Buyer preference, including fit, feel, performance, or compatibility;
- Normal wear and tear consistent with used golf equipment; or
- Issues that were clearly shown in photos or accurately described in the listing.
To request a return or refund, a Buyer must raise the issue with the Seller through the Birdie Chance platform within the timeframe specified in these Terms and provide sufficient information and supporting evidence, including photographs where applicable.
Birdie Chance may review information provided by both the Buyer and the Seller to determine whether an item meets the “significantly not as described” standard. Where approved, Birdie Chance may arrange a return or refund as appropriate.
If a return is approved due to an item being significantly not as described, return shipping will be handled as part of the resolution process. Change-of-mind returns are not accepted.
Approved refunds will be processed back to the original payment method once the issue is resolved. Refund processing times may vary depending on the Buyer’s payment provider.
8. Disputes and Issues
If you encounter an issue with a transaction:
- Buyers must raise any issues relating to an order, including requests for a return or refund, within 72 hours of the item being marked as delivered, unless otherwise required by applicable law.
- Buyers should first attempt to resolve the issue directly with the other party using the Birdie Chance platform.
- If unresolved, the dispute resolution process involves submitting the issue via email, providing relevant evidence (such as photos, shipping receipts, or communications), and allowing Birdie Chance to review and decide the matter in its sole discretion.
We do not guarantee the condition, authenticity, or performance of any item listed on the platform.
9. Prohibited Conduct
You agree not to:
- Use the platform for unlawful or fraudulent activities
- Circumvent payment systems or fees
- Harass or abuse other users
- Post false, misleading, or inappropriate content
Violation may result in account suspension or termination.
10. Community Standards
Birdie Chance is built on trust and respect. To foster a safe and supportive community, you agree to:
- Communicate honestly and respectfully with other users
- Provide accurate information in listings and messages
- Honour agreed transactions in good faith
- Avoid abusive, discriminatory, or offensive behaviour
- Contribute positively to the Birdie Chance community
Failure to meet these standards may result in warnings, restricted access, or account suspension.
11. Termination
Birdie Chance reserves the right to suspend or terminate your access at any time for breach of these Terms or if we believe your use poses a risk to the platform or our users.
12. Limitation of Liability
To the fullest extent permitted by law, Birdie Chance and its owners, directors, contractors, employees, or affiliates will not be liable for any loss, damage, claim, cost, or expense — whether direct or indirect — arising from your use of the platform, your reliance on any content, or your participation in any transaction.
You acknowledge that you use the Birdie Chance platform at your own risk and that all transactions are undertaken between independent users.
If any liability is found to exist, it is limited to the total fees paid by you to Birdie Chance in the 12 months preceding the event giving rise to the claim.
13. Changes to These Terms
We may update these Terms occasionally. Material changes will be communicated via the platform. Continued use of Birdie Chance after changes are posted means you accept the revised Terms.
